ATLANTA — This is an official press release from the U.S. Department of Justice (Federal Bureau of Investigation (FBI)), published as received.

ATLANTA – Justin Neisler was arraigned in federal court today on two counts of possessing child sexual abuse material (CSAM) while incarcerated at the Federal Correctional Institution in Atlanta (FCI Atlanta). This summer, three other FCI Atlanta inmates, Dustin Bishop, Jacob Breslin, and Harold Nuckols, were indicted on similar, related charges of possessing, receiving, and distributing CSAM and other obscene depictions of children while in custody.

“Prison bars allegedly did not stop these defendants from re-victimizing innocent children for their perverted and depraved gratification,” said U.S. Attorney Theodore S. Hertzberg. “Contraband cell phones pose a clear risk to public safety, and my office will continue to arrest, prosecute, and seek additional prison time for inmates who commit new crimes, especially crimes involving child exploitation, while in custody.”

“The exploitation of children is a horrific crime, and incarceration does not put an end to our responsibility to protect victims. These allegations demonstrate the lengths some offenders will go to continue their abuse, even behind prison walls,” said Marlo Graham, Special Agent in Charge of FBI Atlanta. “The FBI and our partners at the Bureau of Prisons will continue working together to identify, investigate, and hold accountable anyone who exploits children.”

According to U.S. Attorney Hertzberg, the charges, and other information presented in court: In March 2026, Federal Bureau of Prisons (BOP) investigators at FCI Atlanta uncovered inmates who allegedly were receiving, possessing, and distributing CSAM amongst themselves. Bishop, who was serving a 10-year sentence for receipt of CSAM, and at least one other inmate allegedly obtained illegal, contraband cell phones and used them to search the dark web for CSAM. Bishop and others then downloaded the CSAM onto SD cards that inmates removed from MP3 players.

Bishop and another inmate then allegedly used an SD card reader—another contraband item—to print the CSAM on the prison library copy machine, sometimes on the back of religious material. Bishop and another inmate then allegedly sold the CSAM to fellow inmates, including Breslin, who is serving a 15-year sentence for possessing and receiving CSAM. Bishop and another inmate also allegedly sold obscene depictions of fictious children engaged in sexually explicit conduct—including depictions of young Disney characters being sexually assaulted—to other inmates, including Nuckols, who is serving a more than 4-year sentence for possessing CSAM. In addition, under Neisler’s pillow, BOP investigators allegedly found a contraband cell phone containing CSAM. Neisler is a former Denver-based physician who is serving a 23-year prison sentence for producing CSAM.

During the investigation, BOP investigators found approximately 450 CSAM images and videos at FCI Atlanta.

Four defendants currently face charges from this investigation:

  • Justin Neisler, 38, of Denver, Colorado, was arraigned today on federal charges of possession of CSAM. A grand jury indicted Neisler on October 27, 2026.
  • Dustin Bishop, 38, of Raleigh, North Carolina, was arraigned on August 31, 2026, on federal charges of distribution of CSAM. A grand jury indicted Bishop on August 25, 2026.
  • Jacob Breslin, 34, of Merritt Island, Florida, was arraigned on August 7, 2026, on federal charges of receipt and possession of CSAM. A grand jury indicted Breslin on July 28, 2026.
  • Harold Nuckols, 29, of Henrico, Virginia, was arraigned on August 7, 2026, on federal charges of possessing obscene depictions of children engaged in sexually explicit conduct. A grand jury indicted Nuckols on July 28, 2026.

If convicted, Neisler and Nuckols face at least 10 years, and Bishop and Breslin face at least 15 years, of imprisonment without the possibility of parole. The Court may order that any additional sentence be served consecutively to a sentence the defendant is currently serving.

Members of the public are reminded that the indictments only contain charges.  The defendants are presumed innocent of the charges, and it will be the government’s burden to prove the defendants’ guilt beyond a reasonable doubt at trial.

This case is being investigated by the Federal Bureau of Investigation, with valuable assistance provided by the Special Investigations Section of the Federal Bureau of Prisons.

Assistant United States Attorney Matthew R. LaGrone is prosecuting the case.

This case is being brought as part of Project Safe Childhood.
