An illegal alien from Guatemala was sentenced to 24 months in prison for assaulting and injuring a federal law enforcement agent who was executing an arrest warrant.

WICHITA, KAN. — This is an official press release from the U.S. Department of Justice (USAO - Kansas), published as received.

WICHITA, KAN. – An illegal alien from Guatemala was sentenced to 24 months in prison for assaulting and injuring a federal law enforcement agent who was executing an arrest warrant.

According to court documents, Miguel De La Cruz-Lux, 22, pleaded guilty to one count of assault of a federal officer.

In January 2026, U.S. Immigration and Customs Enforcement (ICE) agents were in Arkansas City attempting to execute an arrest warrant for De La Cruz-Lux who had been issued a final order of removal by a U.S. Immigration judge. The agents stopped De La Cruz-Lux while he was driving and attempted to explain to him through his closed car window that they had a warrant for his arrest. De La Cruz-Lux refused to comply with the agents’ repeated requests that he roll down his window and open his car door. The agents received authorization from their supervisor to break his driver's side window to remove him from the vehicle. After law enforcement opened his car door, De La Cruz-Lux resisted by holding onto the steering wheel. Agents eventually got him out of the vehicle, and he continued to resist as officers placed him in handcuffs. During this period, the defendant grabbed and twisted one of the agent’s finger, dislocating it.

“Attacks on federal law enforcement agents carrying out their sworn duties as officers are reprehensible,” said U.S. Attorney Ryan A. Kriegshauser. “When a judge issues an arrest warrant for someone, being taken into custody is not optional.”

“Violence against federal law enforcement will not be tolerated,” said ICE Chicago Assistant Field Office Director Chris Chamberlain. “This defendant chose to resist a lawful arrest and physically attack an ICE officer, causing a serious injury. ICE officers put themselves at risk every day to enforce the law and protect our communities. Those who assault them will be held accountable.”

The Immigration and Customs Enforcement (ICE) investigated the case.
